Exhibitor Terms & Conditions

  1. The Exhibitor hereby acknowledges and agrees that, if this Exhibitor Application is accepted by Bright Events Pty Ltd, a binding agreement will arise between the Exhibitor and Bright Events Pty Ltd on the terms and conditions set out herein.
  2. The Exhibitor acknowledges that, if this Exhibitor Application is accepted, Bright Events Pty Ltd will notify the Exhibitor in writing of such acceptance. For the purpose of these Terms of Agreement, the issuing of an invoice by Bright Events Pty Ltd to the Exhibitor in respect of such Exhibitor Application shall be deemed to be sufficient notification to the Exhibitor by Bright Events Pty Ltd of the acceptance of the Exhibitor Application.
  3. The Exhibitor agrees to the following payment terms:
    1. Exhibitors must pay a deposit of Twenty-Five per cent (25%) of exhibitor charges to ensure the stand location they have requested is deemed as booked. The deposit payment is required to be paid by Mastercard/Visa on checkout. Bright Events Pty Ltd will invoice the Exhibitor for the balance of Seventy-Five per cent (75%) of exhibitor charges which the Exhibitor hereby agrees to pay to Bright Events Pty Ltd within Twenty-Eight (28) days of invoice.
    2. If a 25% deposit is not received by the Bright Events Pty Ltd within 7 days of lodgment of the exhibitor application, the stand location can be available for sale to another Exhibitor. This will not be cause for cancellation of the original Exhibitor booking and the deposit will still be required for a new available stand location.
    3. If notification of acceptance occurs on or after 28th September 2018, Bright Events Pty Ltd will invoice the Exhibitor for the balance of the exhibitor charges which the Exhibitor agrees to pay immediately upon receipt of invoice for the same.
    4. For those exhibitors wishing to pay by monthly Installments;
      1. If the application is submitted and deposit paid prior to 15th July 2018, Bright Events Pty Ltd will invoice the exhibitor for 3 payments of Twenty-Five per cent (25%) of the exhibitor charges, to be paid monthly.
      2. If the application is submitted and deposit paid after 15th July and prior to 15th August 2018, Bright Events Pty Ltd will invoice the exhibitor for 2 payments of Fifty per cent (50%) of the remaining 75% of outstanding exhibitor charges, to be paid monthly.
      3. If the application is submitted and deposit paid after 15th August 2018 and prior to 15th September, Bright Events Pty Ltd will invoice the exhibitor for 1 payments of the remaining 75% of outstanding exhibitor charges, to be paid prior to 15th October.
      4. If the application is submitted and deposit paid after 15th September 2018, Bright Events Pty Ltd will invoice the exhibitor for the remaining 75% of outstanding exhibitor charges, to be paid immediately upon receipt of invoice.
    5. Payment by the Exhibitor within the times specified in sub-paragraphs (a), (b), (c), (d) and (e) hereof will be fundamental terms to be complied with by the Exhibitor pursuant to the said agreement between the Exhibitor and Bright Events Pty Ltd.
  4. No exhibitor shall occupy stand space until all exhibitor charges owing to Bright Events Pty Ltd have been paid in full.
  5. This Exhibitor Agreement may not be cancelled, withdrawn or varied by the Exhibitor without the express written approval of Bright Events Pty Ltd.
    1. Any cancellation received in writing prior to the 15th September 2018 will be subject to a 25% cancellation fee. If the booking has been paid in full, the exhibitor will receive a refund of 75%. If the booking has not been paid the 25% deposit paid at time of booking will be retained.
    2. Any cancellation received in writing between 16th September and 15 October 2018 will be subject to a 75% cancellation fee which will be due for payment prior to the event start date.
    3. Any cancellation received between 16th October 2018 and the event date will be subject to a 100% cancellation fee which will be due for payment in full prior to the event start date.
  6. The Exhibitor agrees that the Exhibitor will be bound by the General Conditions of Exhibition published by Bright Events Pty Ltd and included in this Terms of Agreement in respect of Aviatex 2018 and the Exhibitor, together with the Exhibitor’s employees, agents and/or contractors, will be bound by the Exhibition Regulations (including all amendments to such regulations from time to time made by Bright Events Pty Ltd) and all other directions and instructions that may be issued by Bright Events Pty Ltd or its officials.
  7. The Exhibitor hereby agrees to indemnify Bright Events Pty Ltd (and its members, officials and agents) against all loss or damage which they or any of them may sustain as a result of any noncompliance by the Exhibitor or by the Exhibitor’s employees, agents or contractors with the General Conditions of Exhibition, the Exhibition Regulations (as amended) and any other instruction or direction that may be issued by Bright Events Pty Ltd or its officials.

Refunds
If the Event is cancelled due to adverse weather conditions or for any other reason, Exhibitor fees will be refunded in full.

Insurance
All Exhibitors must have in place at all times from before the Move-In Date until after the Move Out Date public and product liability insurance covering all claims arising out of or in connection with the Exhibit or the site under which Bright Events Pty Ltd is noted as an interested party and with a sum insured of not less than $20,000,000. A copy of the Exhibitors insurance policy must be lodged with Bright Events Pty Ltd prior to the start of the event.
